DETAILED RULES AND LEGAL DISCLAIMERS

The purpose of the site is to facilitate the introduction of members to each other who are interested in buying and selling tickets to events at no more than face value. We are based in Ireland and as such hope to establish our user base here first but welcome users from all over the world. For moderation reasons we currently ask all business is conducted in English.

DISCLAIMER
The very nature of this site will involve meeting people in reality. We are not responsible for any misfortune, crime, violence, crushed dreams, marriages, pregnancies or any other events that result from meeting people via this site. It's advisable to ask people to bring ID to sales and meet them in public areas with CCTV cameras. Be careful and use common sense in your dealings.

We can not vouch for members legitimacy. Unfortunately not everyone is honest and there have been scams ran against members by other members in the past. Please familiarise yourself with the advice on using the site safely linked here to assist in avoiding common scams. Please be aware We DO NOT verify whether tickets are real or not and do not have any contact with vendors or purchasers in this regard. Any contractual or other legal rights will exist between the purchaser and the vendor and you are not entitled to any real world or financial reimbursement from the owners of the site in any event arising from the use of the site including but not limited to loss through being scammed. If you do encounter any such issues we do ask that you keep us informed so we can disable dishonest members accounts on the site, a task which we aim to do in a timely manner but we can not guarantee.

Toutless is not affiliated with companies, teams, ticket distributors, promoters, artists, record labels, venues or any other such entity involved in the promotion of events mentioned on this site. Any opinions expressed or actions taken by our users involving these entities are not associated with the owners of this website. We endeavour to check any information provided via this website against available public sources but we are not responsible for mistakes, or issues arising from mistakes, either by us or by other sources.

BY USING THE SITE YOU ARE DEEMED TO ACKNOWLEDGE THE ABOVE TERMS AND CONDITIONS. THE OWNERS RESERVE THE RIGHT TO AMEND THESE TERMS AND CONDITIONS FROM TIME TO TIME WITHOUT WARNING.


RULES
Here are the rules. Instructions on how to use the website are available here. Both instructions and rules may be amended from time to time.
  1. All ticket sales are at face value (plus any booking fee) or less.
    Face value is what is printed on the original ticket. Please state the face value in all sales. Prices will be checked against official online sales points. Booking fees can be passed on but additional mark-ups added by a re-seller, even an "official" one, are NOT allowed to be passed on here. "Platinum tickets", "In demand/dynamically priced tickets" or other overpriced tickets which offer NO advantage to the original ticket other than to provide a method for ticket companies to re-brand touting will not be allowed to be sold at the marked up price here.
    Ticket event insurance is not transferrable and the cost of it can not be passed on if you are selling a ticket.
    Any confusion about what price you should list your ticket at please PM a moderator who are indicated with a coloured username.
  2. Any attempt to break the above rule or encourage anyone to do so by offering above face value for tickets or to advertise sales off board will result in a ban.
    We don’t want to ban people but if you’ve managed to miss what this site is about and go ahead and break our most important rule then we have to assume that you know what you are doing and you are doing it maliciously. We will ban without warning anyone who breaks either the above or this rule. Please report users who attempt to sell you tickets for more than face value or offer you more than face value.
  3. DO NOT post phone numbers or email addresses on the public forum.
    This includes links to personal webpages or profiles on social networking sites such as Twitter or Facebook. This information should be sent using the PM feature only. If posted this information will be removed and repeat offenders banned from the site.
  4. All decisions from the moderators are final.
    We've tried to cover all the angles but if you find some smart way around a rule don't be surprised if you still get banned if what you are trying to do is against the spirit of the site. Any disagreements or arguments will be dealt with as fairly as possible from the facts available to the moderators. Any user or post that endangers the continued running of the site will be removed. Remember use of this site is a privilege not a right.
  5. Common courtesy and sense should be executed when posting.
    No racism, illegal content, libel, leet / txt speak, gimmicks etc. There’s a basic swear list to prevent filtering software in companies blocking the site for people and we ask you do not attempt to bypass it.
  6. It is the sellers discretion who they deal with.
    We ask sellers to try and deal with people who contact them first wherever possible but due to the huge amount of variables (such as availability to meet and specifics regards how many tickets someone may need) this is not something that is enforced. In the case of multiple people looking for the same ticket it is the sellers discretion who they deal with based on what is easier for them to arrange. If for any reason we suspect sellers of creating bidding wars against two or more people looking for tickets we will immediately ban them from the site. Please report these incidents as it is only hurting yourself and other users on the site if this happens.
  7. Ticket Swaps must not profit either party.
    Swapping a ticket is fine but if the tickets are not worth equal amounts any difference has to be made up by the person with the ticket that costs the least. Waiving the difference by the person with the more expensive ticket would be the same as paying more for the lesser ticket. Swaps which involve items other than tickets will assume the SRP for that item. Unique or rare items will only be considered if their value can be clearly shown to be worth the same as the face value of tickets. All non ticket swaps are subject to mod approval.
  8. Only sellers can reduce prices.
    The site is not intended for bargain hunting. We're trying to help sellers as well as buyers and actively discourage attempts by buyers to force prices down. To this end:
    • Do not post requests looking for tickets for less than face value to events. Open requests at lower prices puts pressure on sellers to list at that even if they could quite possibly get face value for a ticket from others.
    • Sellers may offer tickets for gigs under face value, or for free if they wish, as it may be their only way to get rid of tickets for oversold events.
    • Sellers can request offers of lower than their listing price but any offers must be presented to them via PM. Do not post it in the topic as once again this puts pressure on other sellers to list at lower prices.
    • Offers deemed to be time wasting or "arm chancing", we'll go with a rough guideline of offering less than 70% of asking price, can be reported by sellers. Repeat offenders will be removed from the site.
    • Buyers who actively attempt to have sellers undercut each other will be banned.
  9. Be clear in your statements.
    To protect the integrity of the site we need to be sure that people are not attempting to offer more than face value or are looking for more than face value on tickets. Please state clearly your listing price is face value or less when selling. Do not make statements such as "I'll do anything for tickets" if posting wanted requests as we have to assume that this is an open invitation to offer more than face value. This includes "wink wink nudge nudge" statements like offering "good money" or a "good price" or "maybe a little something extra" etc. If at any time you are uncertain about this rule simply state face value is the maximum you are selling or offering.
  10. Keep discussions out of the ticket sales threads.
    If you want to discuss gigs do it in the gig discussion thread. Vice Versa. However if you've any information regarding additional ticket sales or information important to attendees of an event please post it in the appropriate thread in the ticket forum.
  11. Tickets which are locked to the original buyer aren’t allowed be sold.
    For events which require you to show ID to prove you are the named person on a ticket you may not list or request tickets. Discussion on how to circumvent these measures will not be entertained. This includes, but is not limited to, the Glastonbury festival. This also includes non transferable prizes such as addition to guestlists. Complimentary or 0 priced tickets are allowed to be sold at the face value of that event as normal. Tickets for entirely free events must be passed on for free. This rule also prevents the resale of wristbands from previously redeemed tickets. This also covers selling of digital tickets that it is not clear if a transfer option is available.
  12. Only tickets to events can be listed.
    Only tickets that allow access to specific Music, Art, Opera, Theatre or Sports events can be listed.
    Transport tickets, vouchers or open ended tickets to venues are not to be listed. This generally means any air/rail aren't allowed or tickets for access to theme Parks, Farms, etc unless the ticket is for a specific event within a specific time. We recommend http://www.adverts.ie for use in these cases.
    Season tickets for sporting events maybe sold if the original terms and conditions allow them to be.
    Listings for tickets for religious, political or otherwise controversial events maybe removed at the discretion of the admins.
  13. Do not promote touting.
    Do not start topics justifying why you should be allowed tout here. Also do not link to or mention other sites that allow ticket sales for more than cost price. This includes popular auction sites. Toutless is founded on a moral ideal for likeminded people. If you have an issue with this there are plenty of other places without touting rules you can go to however we are not going to help them by giving them free advertising.
  14. Do not commit fraud.
    Taking payment in a deal and not providing valid tickets or taking tickets and not providing payment is considered fraud. Any suspicion of fraud will result in an instant site ban. This ban is considered to be attached to the individual and not the account and will persist to include any additional accounts registered before or after the event that are associated with the individual. Users involved in fraud may have stored information related to their use of the site released to law enforcement officials on request under the allowances within the Irish Data Protection law.
  15. Do not create multiple accounts.
    An account should be per person not per household. An account requires a valid email address to be associated with it at all times. You are responsible for the security and actions of your account. If we suspect an individual of having multiple accounts, one or more or them maybe removed. An account maybe locked if we find the email address associated with it is no longer valid or if it has sat idle for a long time. If we discover someone of having multiple accounts to bypass bans and/or warnings that may put others in the community at risk we reserve the right to publicly announce this discovery.
